The family believes that the use of the photo was a violation of Marsy’s Law and is taking formal action to have the DA’s office taken off the case, claiming it is incapable of handling the process fairly. The DA’s office apologized for causing distress but defended its actions, stating that the men’s conduct has been described in public documents and that crime scene images were shown in a recent Netflix documentary without objection. The court hearing was in relation to the brothers’ resentencing efforts, with Judge Michael Jesic clearing the way for a legal process to determine whether they should be resentenced for the 1989 murders of their parents in Beverly Hills. If former DA George Gascón’s recommendation to reduce their sentences to 50 years to life is approved, the brothers could be eligible for parole immediately and Baralt, the brothers’ aunt, is hopeful they will be released soon after serving 35 years. She expressed concern that she may not live to see her nephews released from prison, as she lives in New Jersey and they are imprisoned in San Diego.
