Several news organizations and attorneys are challenging a Missouri law that prohibits the use of witness and victim names in court records. The law is being disputed on the grounds that it infringes on the public’s right to know who is involved in legal matters and also limits the historical record that court records provide. Attorney Mark Sableman, representing the Missouri Broadcasters Association, argues that removing identities from court records hinders the public’s ability to access important information about legal cases and individuals involved, including professionals such as police officers, public officials, and health care professionals. Sableman and others are seeking to have the law ruled unconstitutional and argue that courts have always had the discretion to protect the privacy of victims and witnesses on a case-by-case basis. The Missouri Attorney General has also raised concerns about the constitutionality of the law but believes it has been applied too broadly. A ruling on the matter is expected after the New Year.
