Texas execution of Robert Roberson halted, he may testify at legislative hearing


Robert Roberson, facing execution for the death of his 2-year-old daughter in 2002, had his execution halted on Thursday as Texas lawmakers intervened with a temporary restraining order. The lawmakers issued a subpoena for Roberson to testify in relation to a 2013 law allowing inmates to challenge convictions based on advancements in forensic science.

Roberson, who claims innocence in his daughter’s death attributed to shaken baby syndrome, is expected to appear in person at a legislative hearing on Monday in Austin. The lawmakers’ efforts bought him more time as they petitioned the Texas Supreme Court late Thursday, ultimately getting a stay of execution. The state’s highest criminal court still allowed the execution to proceed, but the Supreme Court intervened.

The legal maneuvering to stop Roberson’s execution was deemed extraordinary by legal experts. With the possibility of Roberson testifying on Monday, the Attorney General’s office may have to seek another death warrant. Governor Greg Abbott has not disclosed his plans regarding a potential reprieve.

Despite the legal hurdles, lawmakers and advocates for Roberson remain hopeful for justice. State Representative Harrison noted that executing an innocent man is not justice, while attorney Brian Wice highlighted that legal options for Roberson are dwindling. The U.S. Supreme Court declined to intervene, leaving Roberson’s fate in the hands of Texas courts.
