Fulton County prosecutors are seeking to restore six charges in former President Donald Trump’s indictment related to his efforts to overturn his 2020 election loss in Georgia. The prosecutors argue that the charges, including three against Trump for solicitation of violation of oath by public officer, were wrongly dismissed earlier this year by Judge Scott McAfee. They claim that the court erred by requiring specific details about the target crime, which is not necessary for a charge of solicitation.
Prosecutors have requested an oral argument on the matter, while Trump’s lead defense attorney, Steve Sadow, maintains that the dismissal order was correct under Georgia law. McAfee had previously rejected six counts in the indictment against Trump and his co-defendants, citing insufficient details about the underlying felony solicited. The judge later dropped three more counts, including two against Trump, last month.
The case has been on hold due to efforts to disqualify Fulton County District Attorney Fani Willis from her role as prosecutor. Four of the original 19 co-defendants have pleaded guilty, while Trump, Mark Meadows, Rudy Giuliani, and others have pleaded not guilty. The legal battle continues as prosecutors seek to reinstate the charges against Trump, arguing that he solicited public officials in Georgia in an attempt to overturn the election results.
