Therefore, Biden is seeking to have the case against him dismissed. The filing argues that the appointment of and funding for the special counsel were illegal, similar to the reasons cited in the dismissal of the case against Trump. Biden’s legal strategy is to use these recent legal precedents to argue that his case should also be thrown out. It remains to be seen how the judge overseeing Biden’s gun trial will respond to this argument.
