Supreme Court denies Missouri’s allegation of social media censorship

The Supreme Court ruled in favor of the Biden administration in a dispute with Republican-led states over social media censorship. The court threw out lower court rulings that favored the states’ claims the administration was pressuring social media platforms to censor conservative viewpoints. Justice Amy Coney Barrett wrote that the states did not have the standing to sue. Justices Alito, Gorsuch, and Thomas dissented. This case is one of several affecting social media companies and free speech this term, with other cases addressing state laws and public officials blocking followers. The states argued that government officials pressured social media platforms to change content, but the court was skeptical during arguments and warned of potential implications on government communication. Senator Eric Schmitt claimed a victory in exposing the Biden administration’s censorship enterprise. His successor, Andrew Bailey, also claimed a victory and plans to continue the case. The court’s decision keeps the lower court rulings on hold. Some justices wanted the restrictions on government contacts with platforms to be allowed. Free speech advocates wanted the court to draw a clear line on government influence on social media content. Earlier, a federal appeals panel ruled the Biden administration likely exerted unconstitutional pressure on social media platforms. The case is titled Murthy v. Missouri.
